• AI-powered recommendations for cost optimization
• Estimated potential savings calculations
• Analysis history and reporting features

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.

3. User Accounts and Responsibilities

4. AI-Generated Insights Disclaimer

You acknowledge and agree that:

• AI-Generated Content: All recommendations, analyses, and savings estimates are produced by AI algorithms and may contain errors, inaccuracies, or incomplete information.
• Not Professional Advice: The Service does not provide financial, legal, or professional cloud architecture advice. You should consult with qualified professionals before implementing any recommendations.
• Verification Required: You are solely responsible for verifying all recommendations before implementing them in production environments.
• No Guarantees: We do not guarantee specific cost savings, performance improvements, or any particular results from using the Service.
• Your Responsibility: Implementation of any recommendations is entirely at your own risk. We are not responsible for any consequences resulting from following AI-generated suggestions.

5. Payment and Subscription Terms

5.1 Subscription Plans

cloudCostAI offers multiple subscription tiers, including free and paid plans. The features, limitations, and pricing for each plan are described on our pricing page.

5.2 Billing

• Paid subscriptions are billed in advance on a monthly or annual basis
• All fees are non-refundable except as required by law or as explicitly stated in these Terms
• Payment is processed securely through our payment provider (Stripe)
• You authorize us to charge your payment method on each billing cycle

5.3 Price Changes

We may change our subscription fees at any time. We will provide you with at least 30 days' notice before any price increase takes effect. Continued use of the Service after a price increase constitutes your acceptance of the new pricing.

5.4 Cancellation and Refunds

• You may cancel your subscription at any time through your account settings
• Cancellations take effect at the end of the current billing period
• No refunds are provided for partial months or unused portions of your subscription
• You will retain access to paid features until the end of your billing period

You retain all ownership rights to the files and data you upload to the Service ("Your Data"). By uploading Your Data, you grant us a limited license to process, analyze, and store Your Data solely for the purpose of providing the Service to you.

You represent and warrant that:

• You have the legal right to upload and share Your Data with us
• Your Data does not violate any third-party rights or applicable laws
• Your Data does not contain any personal data of third parties without proper consent

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the Service
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from the Service
• Any bugs, viruses, or harmful code transmitted through the Service
• Any errors or omissions in any content or for any loss or damage incurred from use of any content
• Implementation of AI-generated recommendations

7.2 Maximum Liability

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY, OR (B) $100 USD.

8. Disclaimers and Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We do not warrant that:

• The Service will function uninterrupted, secure, or available at any particular time or location
• Any errors or defects will be corrected
• The Service is free of viruses or other harmful components
• The results of using the Service will meet your requirements
• AI-generated recommendations will be accurate, complete, or reliable

9. Termination

9.1 Termination by You

You may terminate your account at any time by contacting us at cloudcostAI.management@hotmail.com or through your account settings.

9.2 Termination by Us

We may suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

• Breach of these Terms
• Fraudulent, abusive, or illegal activity
• Non-payment of fees
• At our sole discretion if we believe termination is necessary to protect the Service or other users

9.3 Effect of Termination

Upon termination:

• Your right to use the Service will cease immediately
• We may delete your account and Your Data in accordance with our data retention policy
• You remain liable for any fees incurred prior to termination

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable international commercial law principles, without regard to conflict of law provisions.

Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes may be resolved through binding arbitration or in courts of competent jurisdiction.
